{"id":231,"date":"2024-09-11T15:42:26","date_gmt":"2024-09-11T15:42:26","guid":{"rendered":"https:\/\/forensicauditors.tech\/?p=231"},"modified":"2024-10-24T05:54:24","modified_gmt":"2024-10-24T05:54:24","slug":"ratificacion-del-informe-pericial","status":"publish","type":"post","link":"https:\/\/forensicauditors.tech\/index.php\/2024\/09\/11\/ratificacion-del-informe-pericial\/","title":{"rendered":"Ratificaci\u00f3n del informe pericial"},"content":{"rendered":"<p>Entre las obligaciones de un<strong> <a href=\"http:\/\/forensicauditors.tech\">Perito Judicial Inform\u00e1tico<\/a><\/strong>, una de las cuestiones que genera dudas frecuentemente es la <strong>Ratificaci\u00f3n del Perito Judicial Inform\u00e1tico<\/strong>: \u00bfdebe presentarse en el juzgado para ratificar su informe pericial? La respuesta es que su presencia no es obligatoria, solo ser\u00e1 necesaria si lo solicitan las partes o el juez. En ning\u00fan caso es un requisito indispensable, y solo estar\u00e1 justificada su comparecencia cuando se considere que la presencia del perito es necesaria para una mejor comprensi\u00f3n y valoraci\u00f3n de su dictamen.<\/p>\n<p>La Ley de Enjuiciamiento Civil (LEC), en su art\u00edculo 348, establece que:<\/p>\n<p>\u00abLos peritos tendr\u00e1n en el juicio o en la vista la intervenci\u00f3n solicitada por las partes que el tribunal admita. De dicho dictamen se dar\u00e1 traslado a las partes por si consideran necesario que el perito concurra al juicio o a la vista a los efectos de que aporte las aclaraciones o explicaciones que sean oportunas.\u00bb<\/p>\n<p>Adem\u00e1s, en el art\u00edculo 429.8 se se\u00f1ala que:<\/p>\n<p>\u00abCuando la \u00fanica prueba que resulte admitida sea la de documentos, y \u00e9stos ya se hubieran aportado al proceso sin resultar impugnados, o cuando se hayan presentado informes periciales, y ni las partes ni el Tribunal solicitaran la presencia de los peritos en el juicio para la ratificaci\u00f3n de su informe, el Tribunal proceder\u00e1 a dictar sentencia, sin previa celebraci\u00f3n del juicio, dentro de los veinte d\u00edas siguientes a aqu\u00e9l en que termine la audiencia.\u00bb<\/p>\n<p>De lo anterior se desprende que, si ni las partes ni el juzgado solicitan la ratificaci\u00f3n o aclaraciones del dictamen pericial, como el <strong>informe pericial inform\u00e1tico<\/strong>, este ser\u00e1 considerado un medio de prueba plenamente v\u00e1lido y eficaz sin necesidad de ratificaci\u00f3n.<\/p>\n<p>El mencionado art\u00edculo 348 de la Ley de Enjuiciamiento Civil tambi\u00e9n establece que el Tribunal valorar\u00e1 los informes periciales de acuerdo con las reglas de la sana cr\u00edtica, y la jurisprudencia reitera que dicha prueba es apreciable de manera discrecional, permitiendo al juez prescindir de su resultado si lo considera oportuno.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Entre las obligaciones de un Perito Judicial Inform\u00e1tico, una de las cuestiones que genera dudas frecuentemente es la Ratificaci\u00f3n del Perito Judicial Inform\u00e1tico: \u00bfdebe presentarse en el juzgado para ratificar su informe pericial?
